Afghanistan

General Right to Vote

  • Chapter 2, Article 33 states, “The citizens of Afghanistan shall have the right to elect and be elected. The conditions of exercising this right shall be regulated by law.”

  • Chapter 2, Article 53 states, “The state shall adopt necessary measures to regulate medical services as well as financial aid ...for reintegration of the disabled and handicapped and their active participation in society. The state shall guarantee the rights of retirees, and shall render necessary aid to... disabled and handicapped...”
  • Chapter 5, Article 84 states, “Members of the House of Elders shall be elected and appointed as follows...including two members from amongst the impaired and handicapped.”

  • Article 50, section 5 states, “The IEC [Independent Electoral Commission] shall ensure that measures are taken to facilitate the vote of persons with disabilities.”

  • Article 14, section 2 states, “The Commission, to the extent possible, shall provide special voting facilities for...disabled people.”

Polling Regulations
(27 November 2008)

  • Article 8, section 1, states, “Nobody is allowed to enter polling states except the following persons...(f) persons authorized to help disabled voters in accordance with the ninth article of this regulation.”
  • Article 11, section 3 states, “A voter who is disabled may request and receive assistance to mark a ballot from an authorized and reliable person or the Polling Center Chairperson, as follows:
  • A person assisting a disabled voter will mark the ballot in the voter’s presence in the way the voter wishes
  • No person except for a Polling Station Chairperson may assist more than one disabled voter to vote.
  • Any assistance given to a voter in accordance with this article shall be recorded in the Polling Station Journal.
  • The person giving assistance to a disabled voter should respect the secrecy of the disabled person’s ballot.
