General Right to
Vote
Constitution:
Article 34 states, "Khmer citizens of either sex shall enjoy
the right to vote and to stand as candidates for the election
Provisions
restricting the right to vote and to stand for the election shall be defined
in the electoral for the election."
Exclusion Based
on Mental Disability
Electoral Law:
(19 December 1997: Law on Election of the Members of National Assembly)
Article 34 states "the following persons shall not be entitled
to stand as candidates for election to the National Assembly
4. insane
persons or persons in custody who are certified as such by a competent
institution."
Article 50 states "
to be eligible to register as a voter,
a person
6. has not been certified as an insane person or a person
under custody by a competent institution."
Voter Assistance
By Other Citizens
Electoral Law:
(19 December 1997: Law on Election of the Members of National Assembly)
Article 97 states "Handicapped electors and electors who are
otherwise unable to vote by themselves may seek the assistance of the
Chairman of the polling station commission, who shall direct one of its
members to help them."
Poll Worker Manuals:
(1997)
Under "Voters Requiring Assistance" it states: "A
voter who is blind or handicapped may request assistance to vote. The
Chairman may assist the person himself or assign another member of the
PSC to do so. The person helping the voter cast his vote: Walks behind
the voting screen and asks the person for which party he wants to vote.
He asks in a way not to be heard by the other persons in the polling station.
He then marks the ballot in the appropriate box corresponding to the voter's
choice and folds the ballot twice so that the mark is inside the fold.
He guides the voter to the ballot box and assists him to insert his ballot
in one of the slots of the ballot box."
