Moldova

General Right to Vote

(1994)

  • Article 38 state,: "(2) Except for persons banned from voting by law, all the citizens of the Republic of Moldova having attained the age of 18...have the right to vote. (3) The right of being elected is granted to all citizens of the Republic of Moldova enjoying the right of voting."

  • Article 11 states, “Citizens of the Republic of Moldova, who by the day of the elections have reached the age of 18, have the right to vote in elections in the Republic of Moldova, except for those deprived of this right as stipulated in the law.”

  • Article 13, section (1) states, “The following individuals cannot vote...b. those declared incapacitated by a final decision of a court of law.”
  • Article 13, section (2) states, “The following individuals cannot be elected...b. persons mentioned in paragraph (1).”

  • Article 54, section (1) states, "The ballot shall be filled out by the voter in a secret voting booth or room. A voter who is unable to fill out the ballot himself has the right to invite another individual into the booth, with the exception of members of the electoral bureau, representatives of candidates, and other accredited individuals entitled to attend electoral procedures."

  • Article 55, section (4) states, “If, for health or other well grounded reasons, the voter is unable to be present in the polling place, the precinct electoral bureau, at his/her oral or written request, shall send no less than two members of the bureau with a special ballot box and everything necessary for voting in the place where the voter is located in order to conduct the voting. On the voter roll beside the name of the respective persons a specification shall be made "voted at the place of stay".”
  • Article 55, section (6) states, "In the event the chairman of the precinct bureau authorizes a special ballot box to leave the polling station, he shall announce this fact beforehand to the accredited representatives and observers present at the station and give them the opportunity to accompany it, using their own transportation if necessary."
