Poland

General Right to Vote
Constitution:
The Constitution of the Republic of Poland of 2nd April, 1997

Article 96, section (2) states: " Elections to the Seym shall be universal, equal, direct and proportional and shall be conducted by secret ballot."

Exclusion Based on Mental Disability
Constitution:
(1997)
Article 62, section (2) states: "Persons, who, by a final judgement of a court, have been subjected to legal incapacitation or deprived of public or electoral rights, shall have no right to participate in a referendum nor the right to vote."

Electoral Law:
(12 April 2001 On Elections to The Seym of the Republic of Poland)

Article 7 states: "The following persons shall not be entitled to vote:
3)those deprived of legal capacity by final ruling of the court."

Voter Assistance by Other Citizens
Electoral Law:

Article 69 states: "A disabled voter, upon request, may be assisted in voting by another person who is not a member of a ward electoral commission or a poll observer authorised by the candidates."

Off-Site Voting Alternatives
Electoral Law:

Article 30 section (1) states: "Polling wards may be established in hospitals and welfare homes with at least fifty resident voters; should the number of voters be lower, a ward may be created after consultation with the head of a hospital or welfare home."

Article 30 section (2)states: "Polling wards may be established for voters in prison or under arrest, as well as external departments of such institutions. Relinquishment of the creation of such a ward shall be possible on the motivated application of the head of a prison or custody centre respectively."
