Transitional Charter

  • Article 1:1 section 1 states, “All sovereign authority belongs to the people of Somalia and may be exercised directly or indirectly through their representatives, in accordance with this Charter and the laws of the country.”

  • Article 31, section 1 states, “A person shall be eligible to be a Member of Parliament if that person...(d) is of sound mind.”
  • Article 31, section 2 states, “A person shall be disqualified from being a Member of Parliament if that person...(b) has been pronounced as being of unsound mind.”
  • Article 40, section 1 states, “Any person shall be qualified and eligible to be elected the President of the Somali Republic, if the person...(e) is of sound mind...”
