  • Section 23, subsection (2) states, “In particular every citizen shall...(f) take part in general elections and referenda...”
  • Section 41 states, “(1) Every citizen shall have the right to take part in the conduct of public affairs, through voting as shall be regulated by law. (2) Every citizen who has attained the age specified by this Constitution or the law, shall have the right to elect and be elected in periodic elections, through universal adult suffrage in secret ballot, which shall guarantee the free expression of the will of the electorate.”

Specific Inclusion of People with Disabilities

  • Section 45, subsection (1) states, “The state shall guarantee to persons with special needs the enjoyment of all the rights and freedoms set out in this Constitution; especially respect for their human dignity, access to suitable education, employment and full participation in society.”

  • Section 53 states, “A candidate for the office of President of the Republic shall...(b) be of sound mind.”
  • Article 59 states, “The Office of the President of the Republic shall fall vacant in any of the following cases...(c) ...physical incapacity...as determined by a resolution of the National Legislature adopted by a three-quarters majority of all members.”
  • Section 86, subsection (1) states, “A candidate for membership of either Chamber of the National Legislature shall...(c) be of sound mind.”
  • Section 87, subsection (1) states, “Membership of the National Legislature shall lapse by a resolution passed by the appropriate Chamber in any of the following cases...(a) mental infirmity...”

  • Section 6, subsection (2) states, “Each of the persons stated in subsection (1) above [members of the National Elections Commission] shall: (e) be of sound mind.”
  • Section 21 states, “The voter shall satisfy the following conditions to be...(e) of sound mind.”
  • Section 41, subsection (1) states, “A person eligible as candidate for election as President of the Republic...shall meet the following qualifications...(b) be of sound mind.”
  • Section 52 states, “A person eligible to be a Candidate for election as member of the Council of States shall meet the following qualifications...(c) be of sound mind.”
  • Section 53, subsection (1) states, “Any person to be eligible as a candidate for election as a member of any of the Legislative Assemblies shall meet the following qualifications...(b) be of sound mind.”
