Constitution
(1988)
- Section 64 states: "Every Tongan subject of twenty-one years of age or more...being a male or female can read and write and is not insane or imbecile and is not disabled by the twenty-third clause shall be entitled to vote in an election for representatives of the people to the Legislative Assembly."
Electoral Law
(1989)
- Section 4, subsection (3) states, “Every Tongan upon attaining the age of 21 years shall, unless disqualified under clause 64 of the Constitution, within 3 months of attaining that age or within 3 months of his return to the Kingdom if not already registered or within 3 months of becoming a naturalised Tongan subject, apply to the Supervisor in Form 1 of the Schedule to be entered on the roll for the district in which he is then residing...”
Exclusion Based on Intellectual Disability

- Section 35 states: "No person shall succeed to the Crown of Tonga who has been found guilty of a felony or who is insane or imbecile."
- Section 63, subsection (1) states, "No person shall succeed to the position of a noble who is insane or imbecile or who is disabled by the twenty-third clause."
- Section 64 states: "Every Tongan subject of twenty-one years of age or more...being a male or female can read and write and is not insane or imbecile and is not disabled by the twenty-third clause shall be entitled to vote in an election for representatives of the people to the Legislative Assembly."
