General Right to Vote
Constitution
(1996)

  • Article 38 states, "Citizens have the right to participate in the administration of state affairs, in All-Ukrainian and local referendums, to freely elect and to be elected to bodies of state power and bodies of local self-government."

On Elections of People’s Deputies of Ukraine
(2005, as amended 2007)

  • Article 2, section 1 states, “The elections of deputies are universal. Citizens of Ukraine who reached the age of eighteen by the day of election are granted suffrage rights in the elections of deputies.”

On Elections of Deputies of Local Radas, and of Village, Settlement, City Chairmen
(1998, as amended 1999)

  • Article 6, section 2 states, “Citizens of Ukraine, who are 18 years of age on the day of elections and who permanently reside in the territory of the respective villages, settlements, cities, rayons in cities, shall have the right to vote in local elections.”

  • Article 70 states, "Citizens of the Ukraine who have attained the age of eighteen on the day elections and referendums are held, have the right to vote at the elections and referendums. Citizens deemed by a court to be incompetent do not have the right to vote."

(2005, as amended 2007)

  • Article 2, section 9 states, “A citizen who has been declared incapable by a court decision shall not have the right to vote.”

On Elections of Deputies of Local Radas, and of Village, Settlement, City Chairmen
(1998, as amended 1999)

  • Article 6, section 3 states, “Citizens of Ukraine found incompetent by a court shall have no right to vote on local elections...”

(2005, as amended 2007)

  • Article 39, section 19 states, “...The general voter list shall also contain information about other possible places of residence of the voter and, if necessary, about his or her permanent mobile disability.”
  • Article 83, section 5 statse, “A voter who cannot mark his/her election ballot on his/her own because of physical incapacity, has the right with the knowledge of the chairperson or another member of the polling station election commission to use the assistance of another person, except for a member of an election commission, a candidate for deputy, an authorized person of a party bloc) or an official observer.”
  • Article 83, section 6 states, “In order to ensure voting of voters with visual impairments, the Central Election Commission shall produce stencils for election ballots (printed in Braille) in the amount of two stencils per ordinary election district. Such stencils may be produced for special polling stations upon submission of the district election commission.”
  • Article 83, section 9 states, “A voter who cannot insert the election ballot into the ballot box because of physical incapacity shall have the right with the knowledge of the chairperson or another member of the polling station election commission to request another person, except for a member of an election commission, a candidate for deputy, an authorized person of a prty (bloc) or an official observer, to do this in his/her presence.”

  • Article 44, section 2 states, “A voter who is incapable to autonomously fill out the ballot, can invite to the booth or room for secret voting any other person except for election commission members, authorized persons of local branches of political parties (blocs), of public organizations, candidates who are campaigning in the given election constituency, and their authorized persons.”

  • Article 84, section 1 states, “The polling station election commission shall give a voter who is included into the voter list in the election district, but due to age, disability or state of health is unable to move independently, the opportunity to vote at the place where this voter stays.”
  • Article 84 details the procedures for the organization of the voting of voters at their place of stay.

On Elections of Deputies of Local Radas, and of Village, Settlement, City Chairmen
(1998, as amended 1999)

  • Article 13, section 5 states, “In stationary medical, sanatorium and health-care establishments, and in other places of temporary stay of voters...polling stations can be formed within the term, established by the third paragraph of this Article, and in exceptional cases- no later than 5 days prior to the elections. Such polling stations shall be parts of election constituencies in which they are situated...”
  • Article 43, section 4 states, “In the event when certain voters cannot, due to health condition or for other valid reasons, arrive at the premises for voting, the polling station election commission shall upon their written application charge at least two commission members to organize voting in the places of these voters’ location. With that, an extract from the list of voters shall be made on the eve of voting in the form of a list which shall be handed by the chairman of polling station election commission to the appropriate commission members along with the necessary number of election ballots, and with the sealed or stamped ballot box.”
