Zambia

General Right to Vote
Constitution
(1991, as amended 1996)

  • Article 75, section (1) states, "Every citizen of Zambia who has attained the age of eighteen years shall, unless he is disqualified by Parliament from registration as a voter for the purposes of elections to the National Assembly, be entitled to be registered as such a voter under a law in that behalf, and no other person may be so registered."

Exclusion Based on Intellectual Disability
Constitution
(1991, as amended 1996)

  • Article 6 section (2) states, “An application for registration as a citizen under this Article shall not be made by or on behalf of any person who, under any law in force in Zambia, is adjudged or otherwise declared to be of unsound mind.”
  • Article 65, section (1) states, “No person shall not be qualified to be elected as a member of the National Assembly if- (b) that person is under any law in force in Zambia, adjudged or otherwise declared to be of unsound mind.”
  • Article 133, section (2) states, “The office of a member shall become vacant- (f) if he is declared or becomes of unsound mind under any law in Zambia.”

Electoral Law
Electoral Act of 2006

  • Section 7 states, “No person shall be qualified for registration as a voter, and no person shall be registered as a voter, who- (d) under any law in force in Zambia, is adjudged or otherwise declared to be of unsound mind, or is detained under the Criminal Procedure Code during the pleasure of the President.”

Local Government Elections Act
(1991)

  • Section 17, subsection (1) states, “A person shall not be qualified for election as a councilor if he- (a) is, under any law in force in Zambia, adjudged or declared to be of unsound mind.”

Electoral Law
Electoral Act of 2006

  • Section 24, subsection (1) states, “The Commission shall allow a person to apply for a special vote if that person cannot vote at a polling station in the polling district in which the person is registered as a voter, due to that person’s - (a) physical infirmity or disability of pregnancy.”
  • Section 60, subsection (2) states, “A person may assist a voter in voting if - (a) the voter requires assistance due to a physical disability.”
