Liability for Violations of Legislation on Local Elections

Voter education poster produced by Ukraine's CEC detailing actions prohibited during local elections in October 2020.

Ahead of local elections in October 2020, Ukraine’s Central Election Commission (CEC) developed voter education posters containing QR codes which linked to corresponding audio and sign language formats. This poster details actions which are prohibited in local elections. The QR codes were added to posters at the recommendation of disabled persons organizations in the CEC’s Election Access Working Group. An English translation of the poster is available below.

 

LIABILITY FOR VIOLATIONS OF LEGISLATION ON LOCAL ELECTIONS

ACTIONS PROHIBITED IN LOCAL ELECTIONS*

 

[Top upper left]: Interference with the free exercise by a voter of his/her voting right, with the activities of another electoral subject, an election commission member or official observer as they exercise their powers or their rights, combined with fraud or coercion or with the use of violence, destruction of or damage to property, threat of violence or of destruction of or damage to property.

[Middle upper left]: Forgery or illegal production of election documents, use or storage of illegally produced or forged election documents, and also inclusion of deliberately misleading information in election documents; stealing, damaging, concealing or destroying of the seal of an election commission, a ballot box containing ballot papers, a voter list or a protocol on the counting of votes, on the results of voting within the respective constituency in the election, or on the election results.

  • from 3 to 7 years [prison icon]
  • with deprivation of the right to occupy certain positions or engage in certain activities for a period of up to 5 years

 

[Middle lower left]: Deliberate violation of the secrecy of voting in the course of the election which manifested itself in the disclosure of the content of a voter’s will.

[Bottom lower left]: Public disclosure by a voter of the results of the expression of his/her will by demonstrating the ballot paper at the polling station.

[Top upper right]: Issuance or reception of a ballot paper by a person who has no right to issue or receive it, or issuance of a completed ballot paper to a voter, or multiple voting by a voter, illegal dropping of a ballot paper into a ballot box, stealing, damaging, concealing or destroying a ballot paper.

[Middle upper right]: Proposal, promise, or provision to a voter, a candidate, or an election commission member of an illegitimate benefit for committing or not committing any actions related to direct exercise by them of their electoral right. Acceptance of the respective proposal, promise, or reception by a voter, an election commission member, or an official observer for themselves or for a third person of an illegitimate benefit for committing or not committing any actions related to direct exercise by them of their electoral rights.

[Middle lower right]: Election campaigning by a person prohibited by law from participating in campaigning, campaigning outside the legally prescribed timeframe or in legally prohibited places, or campaigning in forms or by means that contravene the Constitution or Laws of Ukraine, or other violation of restrictions on campaigning established by the law, except in cases provided for by the Code of Ukraine on Administrative Offenses.
